1. Acceptance of terms
By accessing or using GivChain (www.givchain.io), you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.
2. What GivChain is
GivChain is a decentralised donation platform built on the XRP Ledger (XRPL). We facilitate peer-to-peer donations between donors and recipients.
Important distinctions:
- We do not custody funds — donations go directly from donor wallet to recipient wallet on the XRPL.
- We are not a financial institution, payment service provider, or registered charity.
- We provide technology infrastructure and charity verification services.
3. Account responsibilities
- You are solely responsible for the security of your XRPL wallet, including your private keys and seed phrase. GivChain never has access to these.
- You must provide accurate profile information (name, email).
- One GivChain account per wallet address.
- You must be at least 16 years old to use GivChain.
4. Donations
- Voluntary and final: All donations are voluntary. Once a transaction is confirmed on the XRP Ledger, it is irreversible and non-refundable.
- Currency: Donations are made in XRP or RLUSD. GBP equivalents displayed are estimates based on exchange rates at the time of donation.
- Platform fee: GivChain charges a 0.5% platform fee on each donation. 99.5% of the donated amount reaches the recipient.
- Verification: We verify transactions on the XRP Ledger. We are not responsible for XRPL network outages, delays, or failures.
5. Campaigns
- Campaign creators are responsible for the accuracy and legality of their campaign content, including descriptions and images.
- We reserve the right to remove, suspend, or modify any campaign that violates these terms or applicable law.
- Campaign end dates are informational. Campaigns may continue to accept donations after the stated end date unless explicitly closed.
- For charity-linked campaigns: the named charity has been verified against the UK Charity Commission register (via FindThatCharity.uk). This verification confirms registration status only, not endorsement.
6. Gift Aid
- Gift Aid applies only to donations made to registered UK charities, not to personal crowdfund campaigns.
- By making a Gift Aid declaration, you confirm that you are a UK taxpayer and that the tax you pay is at least equal to the amount of Gift Aid claimed.
- GivChain collects and stores Gift Aid declaration data (name, postcode) to facilitate claims by charities. We do not guarantee HMRC approval of Gift Aid claims.
- Gift Aid declarations are the donor's responsibility. False declarations may result in liability to HMRC.
7. Prohibited uses
You may not use GivChain for:
- Fraud, money laundering, or terrorist financing
- Creating campaigns for illegal activities
- Impersonating charities, individuals, or organisations
- Attempting to manipulate the XRPL, GivChain systems, or exchange rates
- Uploading malicious code, viruses, or harmful content
- Harvesting personal data from other users
8. Intellectual property
The GivChain platform, brand, logo, and codebase are owned by GivChain. Users retain ownership of content they upload (campaign stories, images) and grant GivChain a non-exclusive licence to display this content on the platform.
9. Tax Information and Donor Responsibility
9.1 GivChain provides general information about the UK tax treatment of cryptoasset donations as a convenience to donors. This information is not, and must not be relied upon as, tax, legal, or accounting advice.
9.2 The donor is solely responsible for determining the tax treatment of any donation made through the GivChain platform, including but not limited to Capital Gains Tax, Income Tax, and any reporting obligations to HM Revenue & Customs or any other tax authority.
9.3 GivChain makes no representation or warranty as to the donor’s eligibility for any tax exemption, relief, or deduction in respect of any donation, including (without limitation) the relief available under section 257 of the Taxation of Chargeable Gains Act 1992 or Gift Aid under the Income Tax Act 2007. Donors should consult a qualified tax adviser regarding their own circumstances.
9.4 The 0.5% protocol fee deducted from each donation is consideration paid to GivChain Ltd for the use of the GivChain platform and may, depending on the donor’s individual circumstances, be treated by HMRC as a disposal of cryptoassets distinct from the charitable portion of the donation. Donors should account for this accordingly.
9.5 GivChain accepts no liability for any tax, penalty, interest, or other cost incurred by a donor in connection with a donation made through the platform, save where such liability cannot be excluded by law.
9.6 The information provided by GivChain regarding the tax treatment of cryptoasset donations may change as HMRC guidance, legislation, or case law evolves. Donors are responsible for ensuring they understand the rules applicable at the time of their donation.
9.7 Nothing in this section affects the donor’s statutory rights as a consumer where applicable.
10. Limitation of liability
GivChain is provided “as is” and “as available” without warranty of any kind, express or implied.
- We are not liable for XRPL network failures, exchange rate fluctuations, or wallet security breaches.
- We are not responsible for the conduct, representations, or performance of campaign creators or charities.
- Our maximum aggregate liability is limited to the platform fees you have paid to GivChain in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless GivChain, its founders, employees, and service providers from any claims, damages, or expenses arising from your use of the platform or violation of these terms.
12. Governing law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Changes to these terms
We may update these terms from time to time. Material changes will be communicated via email or a notice on the platform. Continued use of GivChain after changes take effect constitutes acceptance of the updated terms.
